IDENTIFIED SPERM DONOR INFORMATION
When Intended Parents work with an Identified Sperm Donor to inseminate themselves or form their embryos, they are taking an important step for which their child will likely thank them in the future. Donor conceived people consistently report that they want and need access to the sperm donor who made their life possible. It helps them form their own identities when they have access to more information about themselves.
When clients pursue a pregnancy with donated sperm, the Intended Parents and their attorney, and the Sperm Donor and his attorney, will work together to create a Sperm Donation Agreement. We will also create a Mother’s Affidavit Regarding Paternity and a Waiver of Interest so that both the Sperm Donor and the Intended Parents are protected.
After the child is born, we will seek a confirmatory, related parent adoption for the Intended Parent who is not genetically related to the child. While both parents will go on the initial birth certificate, we encourage couples to seek a related parent adoption so that the parent-child relationship between the child and the non-genetic parent is legally cemented and cannot later be rebutted.
If there is no non-genetic parent seeking a relationship with the child, (that is the genetic parent is single) we can not secure an adoption to end the sperm donor’s possible parental rights. Please talk to us about ways to best structure this arrangement to secure everyone involved.”
